Understanding the Process: Medicare Secondary Payer (MSP) Compliance

In December of 2007, the Medicare, Medicaid and State Children’s Health Insurance Program (“SCHIP”) Extension Act of 2007 was signed into law. Section 111 of SCHIP defines specific requirements for liability, no-fault auto and workers’ compensation carriers and self-insurers designed to ensure compliance with the Medicare Secondary Payer (MSP) statute. Failure to comply with Section 111 carries stiff monetary penalties.
As Gallagher Bassett’s Reporting Agent and MSP Compliance Partner, Gould & Lamb’s “OneSource Solution” provides a comprehensive program to mitigate fines, penalties, and legal issues surrounding Mandatory Insurer Reporting (MIR) and MSP, while addressing both the reporting requirements of SCHIP and the compliance issues of the MSP.
While Gallagher Bassett and Gould & Lamb have been working over the last year and half to avoid the stiff monetary penalties SCHIP brings, many of Gallagher Bassett’s clients have begun to realize the way in which claims were settled in the past differs significantly when the injured party is a Medicare beneficiary. As part of any settlement with a Medicare beneficiary, one must make sure Medicare’s interests are protected from both a past (Conditional Payment/Lien) as well as future medical (MSA/CSA) standpoint. Ensuring compliance can often result in the increase in the settlement amount as well as delays in settlement of the claim due to various turnaround times with the Centers for Medicare and Medicaid Services (CMS) and the Medicare Secondary Payer Recovery Contractor (MSPRC).
